USA EB-5 Immigrant Investor Program

EB-5 allows immigrants seeking to enter the U.S. to engage in a commercial enterprise that will benefit the U.S. economy by substantial investment and creation of jobs for U.S. workers.

Applicants can choose to create a new enterprise or invest in a pre-approved Regional Centre. Issued with a Green Card it provides Permanent Residency for the applicant, his or her spouse and any dependents under the age of 21.

Qualifications / Investment Options

Applicants must meet the following requirements to be eligible for the program:

Be at least 21 years of age;
Show legal source of assets and funds of minimum $1,000,000 US;
Choose from one of the available investment options.

There are two investment options within the USA EB-5 Immigrant Investor Program:

1. Invest in a regional center

Regional centres are investment opportunities that have been pre-approved by the U.S. Citizenship and Immigration Services (USCIS). To be eligible for this investment option, the applicant must meet the following criteria:

Make an investment of U.S.$500,000;
The enterprise must create full time employment for at least 10 qualified U.S. workers, where indirect employment is permitted;
Active management of the enterprise is not required.

2. Creation of a new U.S. enterprise

To be eligible for this investment option, the applicant must meet the following criteria:

Make an investment of U.S.$1 million in a new commercial enterprise, or U.S.$500,000 if that enterprise is in a targeted commercial area, which includes rural areas or areas with unemployment of at least 150 percent that of the national average;
Create full time employment for at least 10 qualified U.S. workers, who must be direct employees of the commercial enterprise;
Actively manage the day-to-day activities and/or policy formulation of the enterprise.

USA EB-5 Immigrant Investor Program

The process

Month 1:
- Selection of an investment option and preparation of application.
- Transfer of the Investment and Regional Center Fee
into a nominated escrow account.
Month 2:
- Submission of Citizenship Application after which confirmation of received file is issued.
- Submission of Petition by an Alien Entrepreneur application (I-526) to the USA National Visa Center (NYC).
Month 10-11:
- Immigration petition approval by US authorities.
- Submission of Visa Application (DS-230) to local US consular mission or embassy.
- Medical and health screening.
Month 17-18:
- An interview with the applicant may be conducted.
- Approval of visa and issuance of conditional EB-5. Applicant and family must enter the US with 180 days.

Fees

Regional Center Fees: US$ 50,000

Processing fees: US$ 11,500 for main applicant, US$ 4,400 for spouse, US$ 3,400 for dependent child below 17, US$ 4,400 for dependent above 18, including parents.

Goverment fees: US$ 1,500 for I-526, US$ 405 per person for DS-230, US$ 3,750 for I-829, US$ 2,500 submission fee, US$ 85 per person for biometrics
